Agreement

  • These terms and conditions (“Terms”), together with our Privacy Policy, govern your use of In The Brick’s services and website located at www.inthebrickspa.com.au (“Site”). By accessing our services, making a booking, or using the Site, you agree to these Terms. If you do not agree with these Terms, you must refrain from using our services or browsing the Site.
  • We reserve the right to modify these Terms at our discretion. It is your responsibility to regularly review our current Terms on the Site. Your continued use of our services and the Site implies your acceptance of any changes to these Terms.
Definitions

In these Terms:

  • “In The Brick” refers to In The Brick Business.
  • “Services” refer to the services provided by In The Brick, including massages and related offerings.
  • “You” or “Your” refers to the person or entity using In The Brick’s services or browsing the Site.
  • “Minor” refers to any individuals below the age of 18.

Booking and Use of Services

  • Booking: To access our services, you must make a booking through our Site or by contacting us directly. Additional terms and conditions may apply to specific bookings, which will be made available during the booking process.
  • Access Hours: The operating hours of In The Brick will be posted on the Site and may change at our discretion. This includes temporary closures for capacity, private events, or maintenance.
  • Features: Our services include but are not limited to massages, treatments, and events. Access to specific Features may be restricted based on the terms of the product or service you purchase.

Code of Conduct

  • Respect and Safety: In The Brick is an inclusive space where all individuals must be treated with respect. Any disrespectful or unsafe behavior, whether verbal or physical, may result in removal from the premises and a refusal of entry and services.
  • Follow Instructions: You must follow all instructions given by In The Brick staff. Failure to do so may result in personal risk and injury.
  • Prohibited Activities: You must not use our services or facilities for any purpose other than their intended use. This includes not obstructing common areas, engaging in unsafe behavior, or causing damage to property.
  • Risk Acknowledgment: Please leave valuable items at home, as we are not responsible for their security or loss.
  • Illicit Substances and Alcohol: Illicit substances are strictly prohibited on the premises. Alcohol may not be brought in without authorization. Entry may be refused to those under the influence of alcohol or drugs.
  • Gift Cards

○ Use of Gift Cards: Gift cards may be redeemed for the purchase of massages, products available in our store (such as skincare items), or for accommodations in our hotel located on the upper floors, when available.

○ Validity: Gift Cards are valid for 3 years from the date of issue and are non-transferable. Refunds, transfers, suspensions, or extensions of Gift Cards are not provided for any reason.

○ Loss or Unauthorized Use: We are not responsible for lost, stolen, destroyed, or unauthorized use of Gift Cards.

Booking Cancellations

  • Cancellations or reschedules must be made by emailing us at inthebrickspa@gmail.comor by giving us a call at 03 9555 1191. We accept email cancellations with a time stamp and paper trail. Additionally, you can also modify your booking online via the booking system.
  • Payment: A 50% deposit is required at the time of booking, while a full 100% charge will be applied upon check-in for an appointment. We accept payment with a gift voucher, a vaulted credit card, as well as credit cards, gift cards, cash, and PayPal (if paying at the reception).
  • Cancellation Fees:

○ Cancellations or reschedules can be made up to 48 hours before the Session start time without a fee.

○ Guests who cancel or reschedule a Session more than 48 hours before its start may rebook at no extra cost.

○ Guests who cancel a Session within a48-hour window or fail to attend will incur a 100% cancellation charge and are not entitled to a refund or rebooking.

Pricing

  • All prices listed on the Site and in-store are in Australian Dollars and include GST (unless otherwise specified).
  • All prices displayed on the Site and in-store are subject to change without notice.
  • We may provide promotional discount codes based on our exclusive judgment, with terms and conditions communicated during the corresponding promotional offer or discount period.
  • To the fullest extent allowed by law, we retain the authority to decline a sale to any individual.

Refunds

  • No Refunds: Gift cards are not eligible for refunds.
  • With regard to massage bookings, if a cancellation is made more than 48 hours prior to the scheduled treatment start time, a full refund will be issued to the original payment card. If the payment was made using a gift card, the refunded amount will be credited back to the gift card. If a cancellation occurs within 48 hours of the scheduled appointment, the full amount will be charged, unless the guest contacts us directly via email or phone for further discussion.
  • Consumer Guarantees: These refund policies do not affect your rights under the Australian Consumer Law. We comply with all applicable consumer guarantees under the law.
  • Ecommerce Product Returns Policy: You have a window of 30 days from the date of purchase to initiate a return. To start the return process, please reach out to us via email inthebrickspa@gmail.com to explain the reason for your return, as per our policy. Please keep in mind that we cannot issue refunds for items that have been opened, and we are unable to accept returns for clearance items.
  • Change of Mind/Wrong Item Ordered: If you’ve had a change of mind or accidentally ordered the wrong item, we are happy to accept your return. Simply follow the return process and let us know if you’d like an exchange or a refund. Remember to return the product within 30 days of the purchase date, and you’ll be responsible for covering the return shipping costs. Please ensure the product remains unopened, unused, and in its original packaging.
  • Damaged in Transit/Incorrect Items Received: In the unfortunate event that you receive a damaged item or one that doesn’t match your order, please take a photo and contact us within 7 days of receiving your delivery.
  • Faulty Item: If you believe the item you received is faulty, please provide a photo and a description of the issue, and we will assist you in arranging a replacement or refund.

Legal Capacity

  • Age Requirement: You must be 10 years of age or older to use our services. If you are under 18 (“Minor”), you must have permission from a parent or guardian to access and use our services. Minors found without permission may have their products or services cancelled and entry refused.
  • Accompanied Minors: Minors under 18 must be accompanied by a guardian at all times when using In The Brick’s services.
